Standard of public services of

Grant of permission for change of a land parcel designated purpose

 

  1. General provisions
  2. Public services of “Grant of permission for change of a land parcel designated purpose” (hereinafter – public services)
  3. Standard of public services is developed by Ministry of National Economy of The Republic of Kazakhstan (hereinafter – Ministry).
  4. Public services are provided by local executive bodies of regions, Astana and Almaty, cities of oblast significance, akims of cities of region significance, villages, country districts (hereinafter – service provider).

Reception of documents and outputting of results of public services provision is performed by:

1) service provider’s clerical office;

2) The Republican State Enterprise with the Right of Economic Management Public Service Centre of the Committee of Communications Computerization and Information of Ministry of Investments and Development of The Republic of Kazakhstan (hereinafter – PSC);

3) web portal of on-line government www.egov.kz (hereinafter– portal).

 

  1. Procedures of provision of public services

 

  1. Term of the public services provision:

1) 30 (thirty) calendar days since the day of submission of set of documents to service provider (to Public Service Center or to the web portal).

Service provider in two working days since the day of obtaining of documents of service taker shall check completeness of submitted documents.

In case of insufficiency of submitted documents service provider within the prescribed period of time shall give reasonable refusal in written form of further consideration of application.

At application to the PSC term of public service provision does not include the day of submission of documents;

2) maximum allowable waiting time of submission of set of documents – 15 (fifteen) minutes;

3) maximum allowable servicing time – 15 (fifteen) minutes.

  1. Form of provision of public services: electronic (partially automated) and (or) paper
  2. Result of public services provision – resolution on grant of permission for change of a land parcel designated purpose or reasonable refusal of provision of public services on the grounds described by paragraph 10 of this standard of public services.

Form of outputting of result of public services provision: electronic.

Result of provision of public services can be found in personal account of service taker as electronic document signed by authorised representative of service provider with electronic digital signature (hereinafter – EDS).

In cases of service taker’s written application for result of provision of public services the electronic form of result is printed, certified with a seal and signed by authorised representative of service provider.

  1. Public services are provided to persons and corporate entities (hereinafter – service taker) on free of charge basis.
  2. Work schedule:

1) The work schedule of service provider is Monday through Friday, from 9 a.m. till 6 p.m. with lunch break from 1 p.m. till 2 p.m. except weekends and holidays in accordance with labour legislation of The Republic of Kazakhstan.

Reception of applications and outputting of results of public services provision is done in the period from 9 a.m. till 5 p.m. with lunch break from 1 p.m. till 2 p.m.

Public services are provided in order of arrival, in a walk-in manner, without speed servicing.

2) PSC The work schedule of PSC is Monday through Saturday inclusive, from 9 a.m. till 8 p.m. without lunch break except weekends and holidays in accordance with labour legislation of The Republic of Kazakhstan.

Public services are provided in the way of ticket system without speed servicing. The tickets can be reserved via web portal at the location of land parcel.

3) Work schedule of the web portal – round-the-clock, except for service breaks due to maintenance execution (at service taker’s inquiry after the end of working day, on weekends and holidays in accordance with the labour legislation of The Republic of Kazakhstan reception of applications and delivery of results of public services provision is done on the next working day).).

  1. List of documents necessary for provision of public services at application of service taker (or authorised representative: corporate entity by credentials; person by attested POA):

to service provider, PSC:

1) Application in the form in accordance with Annex 1 of the current standard of public services;

2) Document of identification (required for identification of personality);

3) act of cadastral value of land parcel in case of necessity for purchase of land parcel.

to web portal:

1) electronic application in the form in accordance with Annex 1 of the current standard of public services;

2) electronic copy of act of cadastral value of land parcel in case of necessity for purchase of land parcel.

Service provider and PSC employee get information about identification documents, official registration (reregistration) of corporate entity, evidencing that the land parcel is free of encumbrances, land title and identification documents of the land parcel from corresponding state information systems via On-line government communication server.

Service taker upon provision of public services grants permission to use legally protected secret information contained in information systems unless otherwise stipulated by the law of The Republic of Kazakhstan.

Upon submission of all required documents by service taker to:

service provider – the note of registration in clerical office stating time and date of reception of documents on the copy of application is the confirmation of acceptance of written application;

PSC – signed acknowledgement of reception of corresponding document is given to service taker;

web portal – status on reception of inquiry for provision of public services and notification stating time and date of receiving result of provision of public services are sent to personal account.

PSC delivers documents on the ground of acknowledgement at provision of identification document (or to his representative at provision of notarized letter of attorney).

PSC provides storage of result during one month after which delivers it to service provider for further storage. At service taker’s apply upon the expiry of one month and upon the request of PSC service provider forwards prepared documents to PSC for delivery to service taker within one working day .

  1. Other reasons as provided for in the legislation of The Republic of Kazakhstan.
  2. In case of incompatibility of documents submitted by service taker with the list stipulated in Paragraph 9 of the Standard employee of PSC in accordance with Annex 2 of the Standard issues acknowledgement of refusal to accept document.

 

  1. Procedures for complaint of a decision, activity (inactivity) of service provider and (or) its public officers, Public Service Centres and (or) its staff regarding provision of public services

 

  1. Complaint of a decision, activity (inactivity) of Ministry, service provider and (or) its public officers, Public Service Centre and (or) its staff regarding provision of public services: complaint is made in the name of Director of service provider, Ministry to the address: 8 Orynbor street, Astana.

Complaints are accepted in written form by mail or by courier through clerical office of service provider or Ministry.

Registration of complaint (stamp, registration number and registration date are to be set on second copy of complaint or on complaint cover letter) is a confirmation of complaint acceptance in the clerical office of service provider or Ministry.

In case of incorrect provision of services by PSC staff the complaint shall be made in the name of Director or PSC.

Registration of complaint delivered by mail or courier (stamp, registration number and registration date are to be set on second copy of complaint or on complaint cover letter) is a confirmation of complaint acceptance in the PSC.

At apply via web portal the information about complaints procedure can be acquired by call to Uniform call canter: 1414.

At addressing complaint via web portal service taker from his personal account can access information of his application which is being updated during processing of application by service provider (notes of delivery, registration, execution, consideration response or refusal of consideration).

In complaint:

1) Person shall state its family name, name, patronymic, post address;

2) Corporate entity shall state it’s name, post address, reference number and date.

The complaint of service taker delivered to service provider, Ministry or PSC shall be considered in 5 (five) working days since the day or it’s registration. Substantiated response regarding results of complaint consideration is sent to service taker by mail or given from hand to hand at clerical office of service taker, Ministry or PSC.

At electronic apply via web portal service taker from his personal account can access information of his application which is being updated during processing of application by service provider (notes of delivery, registration, execution, consideration response or refusal of consideration).

In case of dissent with results of provided public services, service taker can address a complaint to authorised body for assessments and observations on quality of provision of public services.

Service taker’s complaint delivered to authorised body for assessments and observations on quality of provision of public services shall be considered in 15 (fifteen) working days since the day or it’s registration.

  1. In case of dissent with results of provided public services, service taker can address a complaint to court in accordance with Law of The Republic of Kazakhstan.

 

  1. Other requirements with reference to specific features of provision of public services including services provided in an electronic form and via public services centres

 

  1. Via applying to universal call-centre – 1414, reception of documents for provision of public services is performed by PSC employee at the place of residence of service takers who in the manner prescribed by the laws is fully or partially unable to perform self-service or move by himself, orientate.
  2. Addresses of places of provision of public services can be found at:

1) Ministry web site www.economy.gov.kz;

2) PSC’s web site www.con.gov.kz.

  1. Service taker have the possibility to receive public services in an electronic form via web portal under condition of possession of EDS.
  2. Service taker is able to remotely get information about procedures and status of provision of services via personal account on website as well as via universal call-centre regarding provision of public services.
