The order of Minister of National Economy of The Republic of Kazakhstan No.151 dated March 30, 2016 Registered at the Ministry of Justice of the Republic of Kazakhstan on April 29, 2016 under No.13652

In accordance with subparagraph 1 of Article 10 of the Law of the Republic of Kazakhstan dated April 15, 2013 “On public services”,
I HEREBY ORDER:
1. To adopt enclosed standard of public service “Acquisition of a right for land parcels belonging to  government  which do not require trading (tenders, auctions)”.
2. Committee for construction, municipal housing economy and land resources management of the Ministry of National Economy of The Republic of Kazakhstan under the current statutory procedure shall provide:
1) official registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) forwarding of a copy of this order in an electronic and written form to printed periodical publications and to Adilet informative legal system for official publication within ten calendar days since the day of its official registration in the Ministry of Justice of the Republic of Kazakhstan, as well as to Republican Centre of legal information for its inclusion to standard control bank of laws and regulations of the Republic of Kazakhstan within five working days since the day of reception of registered order;
3) posting of this order on web site of the Ministry of National Economy of the Republic of Kazakhstan and on internet portal of government agencies;
4) submission of information on implementation of measures specified in subparagraphs 1, 2 and 3 of this paragraph to Legal Department of the Ministry of National Economy of the Republic of Kazakhstan within ten working days since official registration of this order in the Ministry of Justice of the Republic of Kazakhstan.
3. Curatorial Vice Minister of National Economy of the Republic of Kazakhstan shall be entrusted with the supervision over execution of this order.
4. This order comes into use after twenty one calendar days since the day of its frist official publication.

   Standard of public services
“Acquisition of a right for land parcels belonging
to government which do not require trading
(tenders, auctions)”

  

  1. General provisions

 

  1. Public services of Acquisition of a right for land parcels belonging to government which do not require trading (tenders, auctions) (hereinafter – public services)
    2. Standard of public services is developed by Ministry of National Economy of the Republic of Kazakhstan.
    3. Public services are provided by local executive bodies of regions, Astana and Almaty city, cities of oblast significance, cities of region significance, villages, country districts (hereinafter – service providers).
    Reception of applications and outputting of results of public services provision is performed by clerical office of service provider.

  

  1. Procedures of provision of public services

 

  1. Term of the public services provision:
    1) 30 (thirty) calendar days since the day of submission of set of documents to service provider. The stated period of provision of public services does not include the period of drawing up of land use design.;
    refusal of consideration of application upon submission of incomplete set of documents – 2 (two) working days;
    2) Maximum allowable waiting time of submission of set of documents – 15 (fifteen) minutes;
    3) Maximum allowable waiting time of submission of set of documents – 15 (fifteen) minutes.
    5. Form of provision of public services: paper
    6. Result of public services provision – resolution on grant of a right for land parcel or reasonable refusal of provision of public services in cases stated in paragraph 10 of this Standard.
    Form of outputting of result of public services provision: paper
    7. Public services are provided to persons and corporate entities (hereinafter – service taker) on free of charge basis.
    8. Work schedule:
    1) The work schedule of service provider is Monday through Friday, from 9 a.m. till 6.30 p.m. with lunch break from 1 p.m. till 2.30 p.m. except weekends and holidays in accordance with labour legislation of Republic of Kazakhstan;
    Reception of applications and outputting of results of public services provision is done in the period from 9 a.m. till 5.30 p.m. with lunch break from 1 p.m. till 2.30 p.m;
    Public services are provided in order of arrival, in a walk-in manner and without speed servicing
    9. List of documents necessary for provision of public services at application of service taker (or authorised representative: corporate entity by credentials; person by attested POA):
    1) Application in the form in accordance with Annex of the current standard of public services;
    2) document of identification (required for identification of personality).
    Service provider get information about identification documents, official registration (reregistration) of corporate entity from corresponding state information systems via On-line government communication server.
    Service taker upon provision of public services grants permission to use legally protected secret information contained in information systems unless otherwise stipulated by the law of the Republic of Kazakhstan.
    The note of registration in clerical office stating time and date of reception of documents on the copy of application is the confirmation of acceptance of written application upon submission of all necessary documents by service taker;
    10. Grounds for refusal of provision of public services are:
    1) if service taker is in the list of persons who had their land parcels confiscated;
    2) if service taker submitted incomplete set of documents required for making decision on granting of a right for a land parcel

  

  1. Procedures for complaint of a decision, activity (inactivity)
    of service provider and (or) its public officers and (or) its
    staff regarding provision of public services

 

  1. Complaint of a decision, activity (inactivity) of Ministry, service provider and (or) its public officers regarding provision of public services:
    complaint is made in the name of Director of service provider or Director of superior government agency (superior official);
    complaints are accepted in written form by mail or by courier through clerical office of service provider or superior government agency;
    registration of complaint (stamp, registration number and registration date are to be set on second copy of complaint or on complaint cover letter) is a confirmation of complaint acceptance in the clerical office of service provider or superior government agency;
    At apply via web portal the information about complaints procedure can be acquired by call to Universal call canter: 1414, 8 800 080 7777.
    At addressing complaint via web portal service taker from his personal account can access information of his application which is being updated during processing of application by service provider or superior government agency (notes of delivery, registration, execution, consideration response or refusal of consideration).
    In complaint:
    1) Person shall state its family name, name, patronymic (in its existance), post address;
    2) Corporate entity shall state it’s name, post address, reference number and date.
    The complaint of service taker delivered to service provider or superior government agency shall be considered in 5 (five) working days since the day or it’s registration. Substantiated response regarding results of complaint consideration is sent to service taker by mail or given from hand to hand at clerical office of service taker or superior government agency
    In case of dissent with results of provided public services, service taker can address a complaint to authorised body for assessments and observations on quality of provision of public services.
    Service taker’s complaint delivered to authorised body for assessments and observations on quality of provision of public services shall be considered in 15 (fifteen) working days since the day or it’s registration.
    12. In case of dissent with results of provided public services, service taker shall address a complaint to court in accordance with Law of Republic of Kazakhstan.
