A round-table discussion was held in the Nauryzbay District Court of Almaty on the topic: “Issues arising in courts’ consideration of civil cases related to land disputes” discussed the judicial practice of considering land disputes.

The event was attended by a non-governmental public organization Housing without Barriers, representatives of the Akimat of the Nauryzbay District, the Department of Land Relations, the Department of Justice of the City of Almaty Department of the Scientific and Production Center of the Land Cadastre of the Branch of the State Corporation “Government for Citizens” Almaty City Advocates Association №10, “Mediation Development Center”.

The moderator of the meeting was the judge of the district court, Nurlan Murayevich Kaliev.

Opening the work of the “round table”, the chairman of the Nauryzbay district court Tulepbergenov Serikbay Aldabergenovich noted that at present the disputes on this category have a great public resonance. “From their correct and timely resolution depends not only the development and improvement of land and legal relations, but also the socio-political state of society,” he said. The chairman of the district court called the formation of a single legal field and the development of law enforcement practice in the field of regulation of land relations an urgent task.

The report was delivered by Judge Kaliev N.M., in which the problems were noted, specific examples of land disputes were given. It was also noted that the reason for the emergence of disputes on the boundaries of land plots is that many land plots are not at all supplied to cadastral records or are put on cadastral records without defining their boundaries.

During the meeting, the participants of the round table noted that the main reason for the emergence of disputes is the violation of the norms of land legislation when granting or terminating the right of ownership and land use rights, the illegality of the decisions of the regional akim and the decisions of the akimats of the region on granting citizens rights to land plots, Illegality of actions or inaction of commissioners in the sphere of land relations of state bodies.

It is noted that the reason for the emergence of disputes on the boundaries of land plots is that many land plots are not at all put on cadastral records or are put on cadastral records without defining their boundaries.
